Terms and Conditions

These terms apply to quotes, orders and deliveries of modular houses made by MODULO HOUSE. They are written to be understood before you sign, not after something goes wrong. Where a term depends on your particular project — the plot, the country, the model — the quote you receive is what governs, and it says so.

1. Who you are dealing with

The seller is VIVA DOMUS HOME SRL, trading as MODULO HOUSE, with its registered office in Neamț County, Romania.

In these terms, "we" means the seller and "you" means the person or company placing the order.

2. What this website is

The pages of this website describe our models and show what they cost as a starting point. They are an invitation to ask for a quote, not a binding offer.

Prices shown on the site are starting prices for the basic configuration, exclusive of VAT, and exclusive of transport, foundation, crane and any permits. What a house costs for you depends on the options you choose and on where it has to be delivered.

Renders and photographs show typical configurations. Finishes, colours and surroundings may differ from what is delivered; the quote lists what is actually included.

3. From quote to order

You ask for a quote through the form on a model page, by e-mail or by telephone. We reply with a written quote listing the model, the configuration, the price, what is included and what is not, the transport cost calculated for your address, and the delivery window.

A quote is valid for the period stated on it. Prices can change after that, because timber, insulation and transport prices change.

The contract is formed when you accept the quote in writing and we confirm the order. Until that moment neither side is bound.

4. Prices and what they include

Prices are in euro and exclusive of VAT unless the quote states otherwise. VAT is applied according to the rules of the country of delivery.

Unless your quote says otherwise, the price does not include:

  • the foundation or ground works;
  • transport to your site, which is quoted separately per project;
  • the crane and the machinery needed to place the modules;
  • connection to water, sewage, electricity or gas;
  • permits, authorisations, surveys or architect's fees;
  • landscaping, fencing, terraces built on site.

If something on this list is included in your project, the quote says so explicitly.

5. Payment

Payment is made in instalments tied to the stages of production, as set out in the quote and the order confirmation.

Production starts after the first instalment has been received and cleared.

The balance is due before the modules leave the factory, unless the order confirmation sets a different moment.

Late payment entitles us to suspend production and delivery, and to charge statutory default interest.

6. Production and delivery

The delivery window is stated in the order confirmation and runs from the moment the first instalment is received and the final configuration is agreed in writing.

We tell you in advance when the delivery is planned, and we agree the date with you.

Delivery times may be extended by events outside our control — extreme weather, strikes, border closures, failure of a supplier, or any other case of force majeure. We inform you as soon as we know and agree a new date. Such a delay does not entitle either side to compensation.

7. What the site must be ready for

Before the agreed delivery date you are responsible for:

  • a completed foundation, built to the drawing we provide, level and cured;
  • access for a truck of the dimensions we state, and room for a crane to set up;
  • any permits required for delivery, craning and occupation;
  • utilities brought to the points shown on the drawing.

If the site is not ready on the agreed date, the modules are stored and the cost of a second transport, of the crane and of storage is yours. We tell you those costs before they are incurred.

The foundation is yours unless the quote says we build it. A house set on a foundation that does not match the drawing is not covered by the warranty.

8. Delivery, risk and acceptance

Risk passes to you when the modules are placed on your foundation, or at the moment agreed in the quote for deliveries where you organise the transport.

On arrival, inspect the house together with our team and record anything visibly damaged or missing in the handover document, before the team leaves. Visible damage that is not recorded at handover is difficult for either of us to attribute afterwards.

Hidden defects are covered by the warranty below, whether or not they were visible at handover.

9. Warranty

If you are a consumer, you have the legal guarantee of conformity provided by the law of your country, which in the European Union is at least two years from delivery. Nothing in these terms limits that right.

Beyond the legal guarantee, we provide a commercial warranty on the structure and on the works we carry out, under the conditions stated in the quote.

The warranty does not cover ordinary wear, damage caused by works carried out by someone else, changes made to the house after delivery, failure to maintain it as described in the handover documents, or damage from causes outside the house — ground movement, flooding, storms beyond design values.

Appliances and equipment made by others carry their manufacturer's warranty, and we pass those documents to you at handover.

10. If you change your mind

Our houses are made to your order and to your configuration. Under EU consumer law, the 14-day right of withdrawal for distance contracts does not apply to goods made to the consumer's specifications or clearly personalised (Article 16(c) of Directive 2011/83/EU).

That means that once production has started on your configuration, the order cannot simply be cancelled.

Before production starts, you may cancel and we refund what you have paid, less any cost we have already incurred on your project — design work, engineering drawings, materials ordered specifically for you. We show you those costs.

If you want to change the configuration after the order is confirmed, tell us as early as possible. Whether a change is still possible depends on the stage of production, and it may change the price and the delivery date. Any change is agreed in writing before it is made.

11. Drawings and images

The plans, renders, technical drawings and photographs we produce remain ours. You may use them freely for your own project — for a permit application, for a bank, for your architect.

They may not be used to have the same house built by someone else, and they may not be published commercially without our agreement.

The house designs, the model names and the MODULO HOUSE name are ours.

12. Our liability

We are liable for damage we cause by failing to meet these terms.

We are not liable for indirect or consequential loss — lost rent, lost profit, the cost of alternative accommodation — except where the law does not allow that limitation, or where the damage results from our gross negligence or wilful misconduct.

Nothing here limits liability for death or personal injury, or any other liability that cannot be limited under the applicable law. If you are a consumer, your statutory rights are unaffected.

13. Complaints and disputes

Tell us first: office@modulohouse.eu. Most things are resolved by a phone call and a visit.

If we cannot agree, consumers in Romania may address the National Authority for Consumer Protection (ANPC), anpc.ro, including through alternative dispute resolution (SAL): anpc.ro/ce-este-sal. Consumers in other EU countries may turn to the out-of-court dispute resolution body of their own country.

These terms are governed by Romanian law. Where you are a consumer resident in another EU country, this choice does not deprive you of the protection of the mandatory rules of your own country.

14. Changes to these terms

We may change these terms for future orders. The version that applies to your order is the one in force on the day the order is confirmed, and we attach it to the confirmation.

Changes made here do not affect an order already confirmed.
